Adultery is indeed not a punishable crime in most parts of the world.
In India it is made illegal on the premise that it will harm the children and interests of the wife who is traditionally completely dependent on the husband.
Specifically, you get tax breaks when you marry and can name wife and children etc. as dependents. In order to provide a stable upbringing and secure home to children the state asks you to commit to a single partner while you are married. In return you get the benefits you mention.
If you do not want those benefits, you need not marry. Or you can just file for divorce and request the state to free you from your contract.
Breach of this contract with state however while availing the tax breaks etc., is considered illegal by the state.
You of course have the option of NOT availing the marriage benefits given by the state. You can just stay single or have a live-in relationship if you can stand up to social pressure and can find a willing girl.
It is the breach of a contract. State is not asking you to give up any fundamental right, that you are not willing to give up. It will not jail you for staying single. It will not jail you for being with a woman without registering marriage first.
Just as a note, Indian culture never required a public marriage for sex. Else our mythology would never accept and respect people like vidur and Ved vyas. Even hanuman as per the scriptures is said to have a son called Makardhwaj that was born without hanuman being married.
