prostitution arises from poverty and trafficking of women... if you legalise it than traffickig of women would become more common and tommorow may be your sister would be sitting in a brothel...instead of concentrating on the core issues of trafficking and poverty you think it should be legalised..

Saket Mishra making prostitution legal in india is not at all going to solve any problem . The main problem lies in basic needs. No women want to be a prostitute . She comes in this illegal profession due to PAAPI PET KI AAG .. The needs of basic elements . Food , Cloth and Shelter.



The process of legal prostitute is very tedious. The basic steps should be followed , especially in india where people are very much love there religion and every religion prohibits prostitution . To solve this mess the government should provide basic needs of these sex workers.

Oldistan has held a clear and consistent stand on the internal affairs of Youngistan since long, be it living-in, dying-out, bear-hug-bosom-squishing to express warmth and friendship or, legalization of so called prostitution : we have 'laboured' hard for the birth and emancipation of Youngistan and invested in their growth story like hell, and under no circumstances can we permit our interests to be subverted in any manner. Inasmuch as Oldistan refuses to recognize the so called prostitution anywhere, the question of legalizing it anywhere does not arise at all. Oldistan strongly urges Youngistan to honour their commitments to their own harmones and other honourable agreements with their Maker they made at puberty and to marry and live happily ever after, instead of finding excuses like having to learn stupid things in schools and colleges and having to make a living when their living has already been made excellent by their and our Maker, Who, we all know, provides in abundance whatever is needed to live happily ever after. Every decent fairy tale can vouch for this inescapable truth.

As for the Supreme Court directing the Government to do the needful to the so called prostitutes, there can be no two opinions in the matter. There is no such thing as a prostitute. It is a figment of imagination. Some marry, beget children, and provide fathers and mothers to their wards and die happily, job well done. Some do not marry, do not beget children, have a heck of a time, make money and die miserably, botching up the job. That is all there is to it. Nothing needs to be legalized, except that moral suasion will do to make people see reason and live happily and die happily. The Law, long known as an Ass, should not be invoked at all.

As for crimes engendered by so called prostitution, Oldistan is of the firm view that neoteny compels consummation of the most beautiful thing in life, namely, attaining puberty, as marriage at the earliest, which must be celebrated. The so called marriageable age as per law is what needs to be done away with once and for all. This unspeakable blight and blasphemy is of recent origin in mankind's history. Some rascals must have invented it to further their own nefarious needs, into which we will not stoop to inquire at the present juncture, reserving it for a future final assault, for which our forces are raring to go.

Oldistan has made its position clear once again and it is hoped that 'Sense and Sensibility' will prevail and mankind will soon see Paradise Regained in its pristine glory.

Shailendra Kadam Prostitution should not be legalised. It is an insult / blow to the dignity of the person who is following this vocation. Since it is not an honourable means of living or employment, the government should not legalise it.

It is supported by some saying that on legalising it the standard of women prostitutes would improve, this is untrue or far from true. There are women working in government, semi-government, and private sector where they are still working under inhuman working conditions on the pretext of competition, controlling of overheads, equality with men, or being part of essential service provider and many other reasons inspite of labour welfare legislations being passed in the country. So this excuse citing welfare of prostitutes is not tenable. The support for legalising prostitution as a means of employement reflects on the bankruptcy of wisdom of all concerned supporters or so called well wishers of prostitutes.

If the government really wants to improve the living conditions of these prostitutes, government must curb growth of this trade provide for alternate dignified means of employment to existing prostitutes, provide life long free medical aid and hospitalisation for illness and diseases that they suffered due to prostitution and the diseases that may have been transmitted to their children on account of this, counsel them and the kids of the prostitutes must be trained and given better employment / vocational opportunities so that they do not have to go back to this trade of their family. Over a period of time, the house that professes or promotes this trade must curtail this activity and the law enforcement authorities of that area should be penalised for permitting this trade to flourish. It should be treated as a negative mark in the performance report of the collector and other law enforcing agencies and their promotions should be with held. A table should be published in national newspapers and on internet by the local political parties and the collector of the status of prostitutes before elections and post elections every year upto next election, the migration or curtailment. Persons should be encouraged to leave this profession by giving monetary and other support and an audit should be conducted annually to check if the moneys and means made available for taking the people out of prostitution and bringing in the mainstream to profess any decent living are met. If not, persons misusing the taxpayers money should be held accountable and recovered from them or jailed or both.

If the people who profess legalisation of prostitution as a legitimate trade, contract or profession or means of employment, they should first bring dignity to this profession that is looked down by the society. This could be possible only if these people practice what they profess leading by example, making their family members to practice this profession either full time or part-time and during election times they can tell the public by broadcasting through hoardings/pamphlets / television that his/her son, daughter, spouse or they themselves did part-time work as a prostitute since they support the legalisation of this profession of prostitution and publish their photos while in action in the field soliciting clients the way they show their photographs of laying foundation stones of some education institution or a bridge or a subway, a water pipe line, garden, etc. Political parties cutting across party lines who support legalisation of prostitution, should make it mandatory for their candidates contesting any civic, state or national elections if they themselves or their family member has an experience as a prostitute of atleast two years if part-time and one year if full time.

Some say spurt in crime relating to sex is a reason to support prostitution. People committing such offences should be punished and counselled so that their thinking changes and they would not commit such offences again and would also try to stop other from committing them.
Supporting legalisation of prostitutes due to rise in sexual crimes is like telling people use condoms to avoid AIDS. The best way is by leading a decent life, being faithful to your spouse or celibacy. If you are addicted to having sex every now and then with whomsoever is available and if you do not get condom then you could end up having sex without condom and get AIDS free (nowadays there is a craze for having something free with whatever you buy, fact is nothing is free in this world, you end up paying for it ), so you see the main culprit is not being able to control your urge for it.

It sounds good to me when I listen it first. But in very next minute I have a doubt because in my opinion government is fail to stop Terrorism. Supreme court must advise to legalise terrorism.

SC is going to legalise the male prostitution and gay prostitution? I think this is a male chauvinism.

It will increase the number of prostitute who don't want to come in this field. It will lead human trafficking.

Naved Yarkhan The other day ,it was reported,the Supreme Court advised the Attorney-General to consider legalising prostitution since the government is unable to curb it..This pronouncement by the Apex Court raises the question of law that whether the Constitution of India sanctions legalisation of an offence that the executive is unable to control?This question requires interpretation of the Constitution and as per the Supreme Court Rules,it has to be referred to the Chief Justice of India to assign it to a Constitutional Bench to settle.

Mukta Phulapakharu The complete sentence of the SC judge was "If you can not stop the spread of prostitution, then at least legalize it...." I am tempted to think that she had said so in sarcastic manner..

But in case she has not, lets see the reason behind legalizing prostitution.......

1) Its not... it will reduce the crimes against women

2)It will be an act in a hope of improving the conditions of the sex workers, which is really unthinkable today.



But will the decision prove to be significant in any of these issues..? I doubt....

The common school of thought is it will prevent sexual crimes against common women... Would it? this is a complete erratic view without at all considering the psychology of the criminals... who are on their duty... daily.. in bus, train, office.....



Also I dont think that it will improve the status of the sex workers.. They will still be looked at like mudbloods and authorities will continue to take advantage.. in the processes of making it legalize.

And finally what do we do.. about things we think are wrong...... and can not completely stop them? Do we stop working against them and accept them? there are still other things we have not and might never will have complete success again... like1) other crimes.. 2) Terrorist Issue 3)..water..electricity.. and many more...we can not just stop fighting against what is wrong....



Now I am not of a view that prostitution is a crime.... or wrong.....

But.. going by Indian Penal code.. its a crime... then... we should not stop and accept the defeat................. again i think she meant it sarcastically....

Bandra Msm Prostitution has to be legalized so the ladies in that business can live proper lives and have access to bank's ration cards etc. As of now its taken for granted a child born to a prostitute will follow the same business if male will be pimp girl will follow her mother, by legalizing Prostitution these children can have proper education etc. But i guess most of the politicians and the policemen would not like that as large part of their hafta comes from there. Than you have people like RR Patil (yeah the guy who shut down Dance bars-as they were breeding criminals. I am not sure if the crime rate in city/state is gone down by this act.) who will be first to say if prostitution is legalized the (R*****S) will take their business to your door step.

Tat is a profession like any other professions probably her only means to earn her livelihood. No women goes to the flesh trade on her own we should consider the situation for which she is into it rather than punishing a sex worker that will not solve the problem.

Ali Baig Of course not Mr jesse, infact the government should concentrate on creating alternate employment for sex workers. This will make everyone happy in the end. A ban on prostitution does not change their plight, instead, the problem should be treated as a whole and the sex workers should be rehabilitated and provided with new employment opportunities. I know this is difficult given the numbers but we can start now. And saying that its ok for prostitution to exist because rape and incest are prevalent is to turn a blind eye to the whole issue. Mark my words legalising a problem will never be a solution infact will genearte more problems in the future. i advise you alll to first analyze the consequences and repercurssions of any step beofre accepting it blindly and stating baseless reasons.

Manish Dhingra I don agree with you Jesse, Coz according to me a lot of difficulties will arise with the legalization of prostitution, even if some problems supposedly are eliminated.

One issue for sure will be there and which is that by legalizing prostitution, the state appears to be sending the message that prostitution is just fine, that selling intimacy is just another career path.

Another problem that arises is that if prostitution is legal in a country, a large-scale sex trade is likely to emerge, with

"tourists" coming specially to take advantage of the prostitutes. This makes prostitution even more lucrative and more widespread, and at the same time has an adverse effect on the image of the country.

At the same time, in developing countries particularly, prostitution is closely connected with income differentials, with relative poverty closely juxtaposed to affluence. Therefore the accent in dealing with illegal prostitution needs to be not on punishing the women in the trade, but in solving economic development problems in society and, hopefully, for the women caught up in the trade. I agree with the author who mentioned the need to pursue in particular those who seek to hire prostitutes rather than putting all the focus on the prostitutes.

Ganesh R if one were to see from the perspective of the customers, we might understand that they re coming because they have no other outlet. if they are not satiated , might get into the mainstream and commit crimes on society. while prostitution hasn't been controlled by all the legislation and there is no evidence that this will happen in the near future, we cant have thugs and hooligans scaring, bribing officials and torturing young women into this trade . At least if we can have the government controls on this if this is legalized and also confer the health benefits to the workers. that way we can eliminate the criminals from this system.

Shailendra Kadam Do not make it legal. Brinda Ghosh has said it is oldest trade in the civilised world is not correct, persons resorting to prostitution as a trade is no sign of a civilised society. There have been many very old practises like untouchability which have been banned by the Government of India and World Human Rights organisations, so all bad old practices need to be stopped and not legalised.

Pls belive in the fact - we were living with this one of the oldest trade and we are living with this today even - ask any mumbaikar.
YES - Prostitute may get legal Rashan Card, etc, Hafta rate may go down, they may be able to ask thier basic rights.
